What is a commercial lease?

Lease for commercial premises under the Commercial Lease Act: rent, adjustment, maintenance and termination.

What the document must contain

  • The parties and an unambiguous identification of the property or lease.
  • The economics: price or rent, deposit, prepaid rent, utilities and adjustment.
  • The handover or move-in date and what is included.
  • Allocation of maintenance, operating costs and insurance.
  • Terms for termination, breach and moving out, including reinstatement.
  • Any special terms deviating from the statutory default, listed separately.

Frequently asked questions

When do you use a commercial lease?

Whenever parties enter into or change an arrangement about a home, a lease or a property and need the terms documented for later, typically at move-in, sale or a dispute.

Can we contract out of the Danish Rent Act?

Not to the tenant's detriment in residential leases. Terms placing the tenant in a worse position than the Act are void, and agreed deviations must be listed separately.

What about deposit and prepaid rent?

The deposit may not exceed three months' rent, and prepaid rent likewise three months. Both must be stated clearly together with the rules for repayment.

Does it need to be registered?

Agreements on ownership shares, pre-emption rights and easements should be registered to bind third parties. Ordinary leases do not require registration.

Can both parties sign digitally?

Yes. Send the document for signature by email and both parties sign in the browser, with timestamp, IP address and device recorded.
